Service Contract Conditions
- Service accounts must either be paid on
- a cash basis, or
- current Bryan’s Fuel account.
- This service must be paid when invoiced or it can be included in the Equal Payment Plan (EPP).
- There shall be NO liability under this agreement for: Structural alterations to the premises necessary for service, repair, or replacement included in this agreement. Any default, delay in performance, or extraordinary damage hereunder caused by any contingency beyond our control including, without limitations, war, fire, flood, strike, labour disturbance, accident, acts of God, or Government authority. Consequential damages of any nature whatsoever, either arising because of, or resulting from an equipment component failure or the inspection, maintenance, or repair of said equipment. This agreement does not duplicate the protection provided under any other existing warranty or contract. Poor heating and ventilation system performance due to design conditions. Failure to discover latent or manufacturing defects, internal working conditions of sealed components, or unforeseeable occurrences.
- The time, means, and methods to be employed by the dealer in the performance of this agreement, and the repair or replacement of defective materials, parts, or units is solely at the dealer’s discretion. This agreement shall be void if the equipment listed on the agreement, in the dealer’s judgment, has been subject to misuse, negligence, accident, fire, flooding, lightning, electrical overload, wind storm, vandalism, or has been tampered with, or operated contrary to the manufacturer’s instructions.
- This service plan only applies to heating and air conditioning equipment located and operating in the customer’s residence. A service agreement is required for each piece of equipment.
- Bryan’s Fuel reserves the right to decline this service to any of its customers.
- Contracts will be automatically renewed on the agreement’s expiry date unless Bryan’s Fuel is notified of the cancellation.

- Smoke Pipes other than to chimney base

- Non-System Circulating Pumps
- Hydronic Zone Valves
- Refrigerant/Freon
- Condensate Pump
- There is a yearly maximum of $800.00 per appliance covered under this plan starting from the date of contract or renewal date. This plan cannot be renewed in the middle of the contract year.
This AGREEMENT is NOT IN EFFECT until payment is made in full and the acceptance is signed and dated by a representative from Bryan’s Fuel.
